If he mailed obscene videos to an address in the US and these videos were only appropriate for the European market, then he is probably guilty of what he has been accused of.  He never should have sent them, even if someone in the US ordered them.

Very true. A business must operate within the various laws inherent to lands where the business is conducted. This is most especially true of international businesses. These laws extend to any imports and even include distribution of Disney movies, which may still be available in China, for instance, but are "out of print" or "unavailable" for markets in the USA.
