California Gov. Jerry Brown is vetoing legislation requiring police to obtain a court warrant to search the mobile phones of suspects at the time of any arrest.

The Sunday veto means that when police arrest anybody in the Golden State, they may search that person’s mobile phone — which in the digital age likely means the contents of persons’ e-mail, call records, text messages, photos, banking activity, cloud-storage services, and even where the phone has traveled.

So what do you think? Before anyone says that it's only if your arrested they can arrest you for anything if they want to and it doesn't mean they won't drop the charges later.  In the mean time they can have access to anything on your phone, personal potentially embarrassing things.  I am surprised Jerry Brown vetoed it being the liberal he is, but then again liberals seem to want to control people as much as conservatives do these days.  I am sure someone will come up with a wipe app for phones soon that will take care of things before you give up your phone.

It's wrong. I have no problem with them searching your phone if you're charged with certain crimes, but this appears to give the police the ability to search the phone of anyone the arrest, no matter how trivial the alledged crime.

I think it is scary the things the government can do in the name of public safety. I don't think it is right and there are a lot more things the government does that are nor right either. All cops need to do is say they suspect you of something and they can do many many many things. Fuck the police.

Give them an inch and they will take a mile, just wait and see how this will be abused.

Well Michigan is even worse as I just read.

Well think of this.  They search a phone not yours but someone you emailed so your in the contacts, regardless of what it was about you are under suspicion and in the days of homeland security and the drug war anything can set the wheels of big government in motion to roll right over you.

I guess the only answer is to never email anyone.  :viking:

That's freaky. If the police need access to a person's phone records for an investigation, they should have to warrant for it like anything else.

I think that they should have to get a warrant and apparently so did the overwhelming majority of the California Legislature.  I guess there's no way for them to override his veto.
