How much US law is unconstitutional??
« on: January 19, 2011, 02:15:06 PM »
If you look at the law making process, politicians don't give a crap if the bills they pass are contitutional or not.

When a bill is passed into law, is it assumed to be constitutional untill it is successfuly overturned in Federal Court. Obviously, it takes a ton of money to overturn a law, once it has been passed.

Therefore, there has to be a large amout of unconstitutional law in the US.

How much do you think there is??

On a side note, how do you feel about ATM fees ?

I always thought it was wrong that we have to PAY to access our own money. Seems unconstitutional to me.

I belive in some of the banking principles of Anarcho-Capitalism. I don't think they'd permit such a thing.

You got the state laws above the federal laws in the US, which is one of the reasons that the states, counties and cities can break the Constitution. In Germany, for example, it is the other way around. The State of Hesse still has the capital punishment but is not allowed to use it, since the German federal constitution forbids it.

Though I think no constitutions or laws whatsoever are legitimate, even if the US constitution theoretically is the best there ever was. A majority of free people never ever directly gave their consent to found a state, a constitution or a law, not even in America.
